Report Utility Theft
If you suspect or know that someone is stealing utility services, please report it to the Utilities Commission. The Utilities Commission, City of New Smyrna Beach is a municipal utility, and when someone is using our electric or water services without paying, it leads to higher rates for all of our honest customers. In addition, when people illegally and often incorrectly hook up to our electric and water systems, this can pose a major safety hazard for all of us.
Utility theft is a big problem throughout our industry – and it is a CRIME. Florida State Statute 812.14(2)(c) states, "It is unlawful to use or receive the direct benefit from the use of a utility, cable television service, or community antenna line knowing, or under such circumstances as would induce a reasonable person to believe, that such direct benefits have resulted from any tampering with, altering of, or injury to any connection, wire, conductor, meter, pipe, conduit, line, cable, transformer, amplifier, or other apparatus or device owned, operated or controlled by such utility or cable television service or community antenna line service, for the purpose of avoiding payment."
It is a first-degree misdemeanor and anyone convicted could spend up to one year in jail and pay $1,000 in fines. In some circumstances, utility theft could be tried in court as a felony offense.
